"Uncertainty remains concerning the legitimacy of Chairman Shin Dongbin's registration of L Investment Company"

Lotte Group's current Chairman, Shin Dongbin, has been a dominant force in the company ever since his tenure as CEO over the group's key divisions, Japan Lotte Holdings and L-investment companies. Unfortunately for Chairman Dongbin, this does not automatically entitle him to preferential consideration for the Lotte Group CEO position in the mind of his predecessor, Shin Gyukho. The former Lotte Group CEO has made his reservations about Chairman Dongbin's inaugural proceedings well known. In particular, Gyukho's concerns revolve around suspicions that Chairman Dongbin forged legal documents which imbued Dongbin with authority over nine of Lotte's investment companies. As these documents required the validation of former CEO Gyukho, who denies their legitimacy, the probability of illegality surrounding Chairman Dongbin's action remains high. 신동빈, 'L투자' 대표 등기 미스터리...등기신청서 무단 작성 의혹

신동빈(61) 롯데그룹 회장은 외형상 한·일 롯데 모두를 장악했다. 롯데그룹 지배의 핵심고리인 일본 롯데홀딩스와 'L투자회사' 두곳 모두의 대표이사 자리를 차지했기 때문이다.

문제는 이런 신 회장의 잇단 행보가 신격호(94) 총괄회장의 뜻과 합치하지 않는다는 점이다. 신 총괄회장은 지난달 16일 시행된 신동빈 회장의 롯데홀딩스 대표 취임도 '무단으로' 행해진 것이라는 입장이다.

등기 신청일인 지난달 31일 당시 L투자회사 가운데 9곳의 대표이사는 신 총괄회장이 맡고 있었다. 당연히 해당 법인의 변경등기신청서에는 신 총괄회장의 기명날인이 있어야 한다.

그런데 당시 정황 상 이들 등기신청서에 신 총괄회장이 자의로 기명하고 도장을 찍었을 가능성은 극히 낮을 수밖에 없다.
